Learn about South African regulations for accident vehicle deregistration, required documents, step-by-step process, and how to avoid ongoing liability after a write-off.
If your car has been declared a total loss, is uneconomical to repair after an accident, or is permanently unfit to drive, South African law requires you to deregister the vehicle with the relevant licensing authority. This process protects you from future liability, ensures the vehicle's status is accurately recorded, and is essential for owners looking to sell damaged, written-off or salvage vehicles.
According to the National Road Traffic Act and the National Road Traffic Regulations (NRTR), these scenarios require formal deregistration from the eNaTIS system. Most insurers in South Africa will notify the owner when a car is deemed 'uneconomical to repair' or 'written-off', but the responsibility to complete deregistration ultimately rests with the registered vehicle owner.
| Responsibility | Approximate Cost | Estimated Timeline |
|---|---|---|
| Owner | R50-R200 | 1-7 working days |
| Assisted/Third-Party Service | May include admin fees | 1-10 working days |
Fees and timelines can vary by region and the nature of the vehicle's status. Some services, like Sell Your Damaged Car, handle all paperwork and deregistration for owners automatically as part of the sale process.
Deregistering a written-off or accident-damaged car is a legal obligation in South Africa. If you fail to deregister the vehicle:
| Document | Purpose | Who Provides It? |
|---|---|---|
| Completed ADV/NCO Form | Notification of deregistration/disposal of vehicle | Owner/Seller |
| Certified ID | Proof of identity | Owner |
| Proof of Address | Verify current contact address | Owner |
| Settlement/Insurer Letter | Confirms status/written-off classification | Insurer/Owner |
| Police Clearance (if required) | Prevents fraudulent re-registration | SAPS |
If your accident-damaged car is still under finance or insurance claim, coordinate with the bank or insurer for settlement and deregistration. In most cases, the bank must provide a settlement letter and sometimes liaises directly with the licensing authorities.
Once deregistration is complete, your responsibility for the vehicle ends: you stop paying licence fees, no longer bear any legal or traffic liability, and can safely dispose of or sell the salvage. The vehicle will be marked as Code 3 (permanently unfit) or Code 4 (to be scrapped) on the eNaTIS system, and cannot be legally driven on South African roads.
