Don't take risks: learn the steps to legally transfer ownership when your car is collected or towed in South Africa. See required paperwork, tips, and official links.
When you sell a damaged, non-running, or written-off vehicle and it's collected by tow truck, transferring legal ownership properly is crucial. This protects you from future fines, liability, or disputes should the vehicle be abandoned, involved in further incidents, or improperly processed by a salvage firm. In South Africa, compliance with the National Road Traffic Act is mandatory during any change of ownership.
If your car is towed away-by a private buyer, dealership, insurance company, or a service like Sell Your Damaged Car-you must complete official paperwork with the buyer before and during handover. Don't skip this step, even if the car is not roadworthy.
Selling a car that cannot be driven may be preferable to spending on costly repairs or storage fees. If your car is non-running, accident-damaged, or written off, and you've decided to accept an offer for collection, confirm that all legal transfer steps are clear before the tow truck arrives.
| Scenario | Required Action | Risk if Not Done |
|---|---|---|
| Car sold to buyer (private, business, salvage service) | Complete change of ownership forms with buyer present | Liability remains with you for fines, e-tolls, accident claims |
| Car is scrapped or deregistered | Submit deregistration forms at the traffic department | Continued licence fees, legal exposure |
Both parties should sign the paperwork before the tow truck departs. The buyer then submits the relevant documents to their local licensing authority. Request a copy or receipt confirming transfer, when possible.
Under South African law, the seller must notify the licensing department of ownership change within 21 days of sale-even if the car is wrecked or unroadworthy. If you're using a professional car-buying service, ensure they manage this on your behalf and obtain proof. Here's a summary of the required forms and tips for each situation: Change of Ownership for Scrap or Spares Cars in South Africa: Step-by-Step Guide
| Document | Purpose | Where to Submit |
|---|---|---|
| Form NCO | Notifies traffic authorities of sale/transfer | Traffic/licensing department |
| RC1 (Registration Certificate) | Proof of ownership; required for transfer | Provided to buyer |
| ID copy | Verification of seller identity | With change of ownership form |
| Deregistration form (if scrapping) | Remove car from national register | Traffic/licensing department |
If your vehicle is still under finance, consult your bank before signing any change of ownership paperwork. Authorisation from your financial institution is mandatory.
