Learn the legal requirements for selling a written-off car in South Africa: disclosure, deregistration, finance settlement and practical compliance tips for private owners and fleets.
Key Legal Steps
Disclose write-off status, provide ownership proof and complete deregistration or transfer.
Finance & Liability
Settle or confirm finance release and request written confirmation to avoid future liability.
Simplify with a Specialist
Use a buyer who offers free towing, paperwork handling and transparent offers.
Selling a written-off car involves more than getting a cash offer - there are legal steps, insurer and registration obligations, and market realities to consider. This guide explains the South African legal requirements, practical steps for private sellers or small fleet owners, and how using a specialist buyer can simplify the process while protecting you from common pitfalls.
A vehicle is commonly described as written-off when an insurer deems repair uneconomical relative to the vehicle's market value, or when damage affects structural integrity or safety. Written-off status can be recorded by insurers and can affect future registration, resale and insurance. If you are unsure how your insurer classified the car, request confirmation in writing.
Deciding whether to repair or sell depends on repair costs, the vehicle's pre-accident market value and your tolerance for time and risk. Repairs can be expensive and may not restore resale value to pre-accident levels. Selling a written-off car can reduce ongoing costs, avoid storage and handling hassles, and transfer responsibility for salvage repairs to a buyer.
| Scenario | Repair cost (estimate) | Value retained after repair (estimate) |
|---|---|---|
| Minor cosmetic damage | R2,000-R10,000 | 80-95% of pre-accident value |
| Moderate structural or mechanical | R15,000-R60,000 | 50-75% of pre-accident value |
| Severe frame/flood/fire damage | R50,000+ | Often below 50% or considered salvage |
Specialist buyers who purchase written-off vehicles aim to streamline the legal and logistical steps. The usual flow is: submit vehicle details and photos, receive an assessment and offer, accept if agreeable, and the buyer arranges collection and handles paperwork. Using a buyer that provides free towing and manages deregistration can remove much of the seller's administrative burden. For a clear outline of how a trusted buyer operates, see our About / How it works page.
| Damage type | Typical impact on offer |
|---|---|
| Superficial cosmetic | Minor reduction; competitive cash offer still possible |
| Engine or transmission failure | Significant reduction; non-running status affects towing/logistics |
| Structural/frame/flood/fire | Largest impact; vehicle often treated as salvage |
For a step-by-step sales flow for non-running vehicles, our Sell Non-Running Car page explains typical timings and document needs.
When selling a written-off vehicle in South Africa you should confirm and complete the following items to remain compliant and protect yourself from future liability:
Important: If police or insurer records list the vehicle as stolen or subject to an insurance claim, resolve those matters before sale. Selling a vehicle with unresolved criminal or insurance status may result in legal consequences.
After you accept an offer and the buyer collects the written-off car, typical next steps include completion of transfer or deregistration forms, settlement of any finance on the vehicle, and confirmation of payment to the seller. Reputable buyers will provide a receipt and confirmation that they will handle transfer or deregistration with the relevant provincial eNatis office.
Example scenario: a Johannesburg private owner with a written-off hatchback. They submit photos and documents, accept an offer, the buyer settles the outstanding finance (if any) directly with the financier, arranges free towing from the owner’s driveway and completes the deregistration documents with Gauteng eNatis. The seller receives confirmation and payment once the paperwork is verified. Figures and timings will vary; the example above is illustrative and not a promise of outcomes.
If you want a quick online valuation and an offer that factors written-off status, our Sell Damaged Cars page outlines the types of damage we buy and the documents commonly requested. To return to our main service homepage and start a submission, use Sell Your Damaged Car.
