Explore your legal options and step-by-step process to renew, deregister, or sell Gauteng scrap cars with expired license discs. Avoid unnecessary penalties and ease paperwork.
In Gauteng, many car owners face a common problem: a vehicle that's been damaged, written-off, or is no longer roadworthy, but still has an expired license disc. If your car is a candidate for the scrap yard-or just stuck non-running in your garage-the licensing dilemma can get confusing and costly. You might be wondering if you must settle all arrears before selling, deregistering, or scrapping the car, especially if hefty penalties have accrued over months or years.
The official position from the South African National Road Traffic Act is clear: all cars on the National Vehicle Register (NVR) require annual license renewal fees until deregistration. However, the actual process for scrap cars provides sensible alternatives-if you know your rights and obligations.
If your car has been idle for a long period, missed annual license renewals will lead to outstanding arrears, and penalties accrue monthly. Scrapping, selling to a salvage buyer, or formal deregistration is usually more practical than keeping up with ongoing fees.
| Option | Do You Need to Pay Arrears? | When to Use | Key Notes |
|---|---|---|---|
| Renew License Disc | Yes | If you want to keep/restore the car on public roads | Arrears and penalties must be settled for renewal |
| Deregister as Scrap | Not for post-accident/scrap vehicles | If car is written-off, unrepairable or sold to a salvage buyer | Supporting documents and forms required; clears license arrears for future owner (see below) |
| Sell to Salvage/Car-Buying Service | No (handled via deregistration) | If you want to convert scrap/non-running vehicle to cash quickly | Reputable buyers handle paperwork, deregistration, and provide written records |
Deregistering as scrap removes your responsibility for licensing and penalties going forward. According to Gauteng licensing authorities, you are not required to settle past-due license fees if valid proof is provided that the vehicle is now unroadworthy or scrapped. This is especially important for owners of severely damaged cars or those selling vehicles to salvage yards, accident buyers, or car-buying services like Sell Your Damaged Car.
| Vehicle Status | Expired Disc Impact on Selling |
|---|---|
| Accident/Non-Runner (for scrap only) | Minimal to none (as buyers handle deregistration, not road use) |
| Roadworthy/Restorable | Significant, as arrears must be settled before transfer/renewal |
If you're selling to a specialist buyer that purchases written-off, salvage, or non-running cars, they normally handle all deregistration and paperwork, minimising your admin and removing liability for overdue licensing fees.
Once the car is officially deregistered as scrap, you are no longer responsible for licensing, penalties, or vehicle-related traffic liabilities. The new owner (typically a dealership or buying service) takes over any further admin. Your last step: keep your deregistration proof safely filed for future reference, and validate that your name has been removed from the eNatis/NVR system for complete peace of mind.
